Terms & Conditions
1. Parties & Scope
These Terms & Conditions (“Terms”) govern all photography services (“Services”) provided by Just Gonz Photography, Precursor Consulting LLC (“Photographer”) to the client (“Client”) for portrait, headshot, event, boudoir, lifestyle, editorial, and related photography bookings.
By booking a session, the Client agrees to be bound by these Terms.
2. Booking, Payment & Refunds
A booking is considered confirmed once the Client has completed the online booking process and any required payment or deposit.
The Photographer will call the Client within 12 hours of booking to confirm details, review expectations, and answer initial questions.
The Client is responsible for providing accurate contact information and promptly responding to any requests for clarification.
Refunds:
A full refund is available if the service is cancelled within 2 hours of initially booking, or before the stated cancellation deadline for the specific photography service (see Section 4).
After these windows, all sales are final, unless otherwise noted in writing by the Photographer or required by applicable New York law.
3. Session Types, Duration & Locations
3.1 Portrait & Headshot Sessions
Typical portrait/headshot sessions run 60–90 minutes on location in NYC.
Portrait & Headshot Sessions are not in-studio by default. Unless studio time is:
Added during the booking process, or
Arranged separately by contacting the Photographer,
all Portrait & Headshot Sessions will take place:At a location of the Client’s choosing (e.g., place of business, home, hotel, etc.), or
In an appropriate artist street/location selected by the Photographer, after consulting with the Client.
Studio time, when requested, is billed at $150 for 90 minutes, in addition to the session fee.
3.2 Event Photography
The standard event photography booking includes 3 hours of coverage.
If additional coverage is needed and was not added during the booking process, the Client must contact the Photographer as soon as possible so coverage can be adjusted, subject to availability.
Additional time is billed at $150 per additional hour (or portion thereof).
4. Cancellation & Rescheduling
4.1 Portrait & Headshot Sessions (24-Hour Policy)
There is a 24-hour cancellation policy for portrait and headshot sessions.
If the Client cancels:
Before the 24-hour deadline and within the overall refund rules in Section 2, the Client may receive a full refund or reschedule, subject to availability.
With less than 24 hours’ notice, the booking is generally non-refundable, and rescheduling may be limited and is at the Photographer’s discretion, subject to any rights the Client may have under applicable New York law.
4.2 Event Photography (48-Hour Policy)
There is a 48-hour cancellation policy for event photography bookings.
If the Client cancels:
Before the 48-hour deadline and within the overall refund rules in Section 2, the Client may receive a full refund or reschedule, subject to availability.
With less than 48 hours’ notice, the following applies:
The Client will receive a credit for a future shoot, and the Photographer will do their best to reschedule to the new event date/time based on availability.
If a mutually workable time cannot be found, the Client may choose either:
A 50% refund of the original booking amount, or
A full future credit of the booking amount, applicable to any photography service offered by the Photographer.
5. Changes, Timing & Logistics
The Client should notify the Photographer as soon as possible of any last-minute changes, ideas, or adjustments to their portrait, headshot, event, or other coverage.
For events, the Client must promptly inform the Photographer of changes to the schedule, venue, timeline, or coverage needs, as these may impact logistics and what can be captured.
Significant changes requested after booking (e.g., extended coverage, additional locations, major timeline shifts) are subject to the Photographer’s availability and may incur additional fees.
6. Image Creation & Style
The Client acknowledges that the Photographer’s work is characterized by documentary honesty and fine-art restraint—clean composition, cinematic light, and a focus on real moments over artificial staging.
For weddings and elopements, coverage is documentary-driven, favoring genuine connection over stiff posing, with emphasis on the people and atmosphere that make the day unique.
For events, the Photographer works with energy and intention, reading the room, chasing the light, and keeping a discreet footprint, balancing big scenes with small details.
By booking, the Client confirms they have reviewed the Photographer’s portfolio and are hiring the Photographer for their artistic style and professional judgment. No particular pose, person, or moment is guaranteed.
7. Image Delivery, Turnaround & Formats
7.1 Standard Turnaround
For most portrait, headshot, event, lifestyle, and editorial assignments, the Photographer aims to provide:
Same-day or very fast “selects” (a small preview set) when feasible, and
A full edited gallery within 48–72 hours of the end of the shoot,
unless a different schedule is agreed in writing. These timeframes are goals rather than guarantees, but the Photographer will make reasonable efforts to meet them.
7.2 Events, Editorial & Press
For events and editorial/assignment work, same-day or next-day selects may be provided for press and social media use, where requested and agreed in advance.
Event and editorial galleries are delivered as publication-ready files suitable for press, socials, and print, unless otherwise specified.
7.3 Delivery Method & Gallery Access
Images are delivered digitally via a secure, password-protected online gallery, where the Client can review, select (where applicable), and download files.
Final files are provided as high-resolution images optimized for both web and print, unless a different format is agreed.
Boudoir and other intimate sessions are delivered in private, secure galleries with heightened privacy considerations (see Section 9).
7.4 Rush Turnaround
Rush turnaround (faster-than-standard delivery) may be available upon request.
Rush services are subject to the Photographer’s availability and may incur an additional fee, to be agreed in writing before the shoot or at the time of booking.
7.5 Longer or Complex Assignments
Multi-day events, long-form documentary projects, commercial campaigns, fine-art commissions, or assignments involving extensive retouching, album design, or printing may require custom delivery timelines.
Any custom timeline will be outlined in the proposal, contract, or booking confirmation and will supersede the standard turnaround in this section.
8. Usage Rights & Copyright
Unless otherwise agreed in writing, Just Gonz Photography, Precursor Consulting LLC retains full copyright to all images created.
All images and content on the Photographer’s website and galleries are protected by U.S. and New York copyright law. Unauthorized use, reproduction, or distribution of any images, text, or content—online or offline—is strictly prohibited. Written permission must be obtained prior to any use not explicitly licensed to the Client.
For standard portrait, headshot, and personal sessions, the Client is typically granted a non-exclusive, non-transferable license for:
Personal use (including sharing on personal social media, printing for personal display, and use on personal websites or portfolios), and
Reasonable professional self-promotion (such as LinkedIn, personal websites, speaker bios, and press features about the Client), unless otherwise limited in writing.
For editorial, commercial, brand, hospitality, and fine-art usage, the Photographer offers editorial, commercial, and fine-art licenses tailored to the Client’s usage (e.g., campaigns, advertisements, packaging, widespread print, or third-party publications).
The scope of any commercial or editorial license—including territories, duration, and media—will be clearly defined in writing. Usage beyond the agreed license requires a new or expanded license and may incur additional fees.
The Client may not:
Sell images to third parties,
Submit images to stock agencies, or
Grant usage rights to others
without the Photographer’s prior written consent, unless such usage is clearly included in the written license.
9. Photographer’s Use of Images
Unless the Client requests otherwise in writing before or during the session, the Photographer may use images from non-boudoir sessions for:
Portfolio and website galleries,
Social media and online presence,
Studio samples, printed portfolios, and exhibition displays, and
Marketing and promotional materials for Just Gonz Photography, Precursor Consulting LLC.
The Photographer will take reasonable care with images used for public promotion and will respect any reasonable privacy or sensitivity concerns communicated by the Client.
Boudoir & Intimate Portraits:
Boudoir and similarly intimate sessions are grounded in trust and privacy. By default:
These images are delivered via secure, password-protected galleries, and
They are treated as confidential and are not used in public portfolios, social media, exhibitions, or promotional materials without the Client’s explicit, written consent.
Select images from boudoir or intimate sessions may be offered as fine-art prints or included in exhibitions only with the Client’s explicit consent. Most such sessions remain entirely private.
10. Client Responsibilities
The Client is responsible for:
Securing any permissions, permits, or location access required for the shoot (e.g., venues, rooftops, private properties, public spaces with permit requirements), unless otherwise agreed.
Ensuring that all participants and guests understand that photography will be taking place and that they behave in a way that maintains a safe, respectful working environment for the Photographer.
Informing the Photographer in advance of any key moments, people, or details that are especially important to capture (e.g., specific family groupings, speeches, performances, product details).
The Client agrees to communicate clearly about intended image usage (website, print, press, social media, campaigns, etc.) and any deadlines, so the Photographer can recommend appropriate coverage, licensing, and delivery timelines.
For sessions involving minors, the Client (or legal guardian) is responsible for providing any required consents or releases for the creation and use of images, consistent with New York law.
11. Limitations of Coverage & Liability
While the Photographer will make every reasonable effort to capture important moments and provide prompt delivery, the Client understands and agrees that:
No specific image is guaranteed.
Coverage may be affected by factors outside the Photographer’s control, including but not limited to weather, venue restrictions, late or absent subjects, schedule changes not communicated, and interference by guests or third parties.
The Photographer is not responsible for:
Missed images due to late changes, lack of communication of key moments, or restrictions (e.g., “no flash” rules, restricted access areas).
Image quality degradation arising from the Client’s own copying, printing, or distribution methods once files have been delivered.
The Photographer maintains professional equipment and backup workflows; however, in the unlikely event of:
Complete equipment failure,
Serious illness, emergency, or other circumstance preventing the Photographer from performing, and
No suitable replacement photographer being available,
the Photographer’s liability is generally limited to a refund of fees already paid and/or rescheduling where possible, unless otherwise required by New York law or agreed in writing.
To the maximum extent permitted by New York law, under no circumstances shall the Photographer be liable for any indirect, consequential, or incidental damages arising from the performance (or non-performance) of the Services beyond the amount paid by the Client for the booking in question.
12. Force Majeure
Neither party shall be liable for failure to perform obligations where such failure is due to circumstances beyond reasonable control, including but not limited to natural disasters, government restrictions, war, strikes, extreme weather, public health emergencies, or other “force majeure” events.
In such cases, the Photographer will work with the Client in good faith to reschedule or credit the session, applying the cancellation and refund principles in Sections 2 and 4 as reasonably as possible under the circumstances, consistent with New York law.
13. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
The parties agree to submit any disputes that cannot be resolved through good-faith negotiation to the state courts of New York located in New York County or the federal courts in the Southern District of New York, and each party consents to the personal jurisdiction of such courts, except where New York law requires a different venue or forum.
14. Acceptance
By completing a booking and submitting payment, the Client confirms that they have read, understood, and agree to these Terms & Conditions for services provided by Just Gonz Photography, Precursor Consulting LLC.
